Terms of Service

1. Agreement to Terms

By accessing or using SweetSpot ("Service"), operated by SweetSpotCRM Ltd. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including individual users and organizations subscribing on behalf of their teams ("Subscribers").

2. Description of Service

SweetSpot is an AI-powered, mobile-first field sales management platform designed for sales teams. The Service includes, but is not limited to:

  • AI-powered sales assistant ("AleX") for voice and text-based commands
  • Mobile application for iOS and Android platforms
  • Lead, contact, and deal management
  • AI-generated proposals and document management
  • Sales pipeline and activity tracking
  • Reporting and analytics
  • Third-party integrations

3. Account Registration and Security

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Promptly notifying us of any unauthorized use of your account
  • Ensuring all information provided remains accurate and up to date

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account and use the Service.

4. Subscriptions and Billing

4.1 Free Trial

We may offer a 30-day free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. You will not be charged during the trial period.

4.2 Billing Cycles

Subscriptions are available on monthly or annual billing cycles. Annual plans include a 10% discount compared to monthly billing. All prices are quoted in US Dollars (USD) per user per month unless otherwise stated.

4.3 Payment Processing

Payments are processed securely through Stripe, our third-party payment processor. By subscribing, you agree to Stripe's Terms of Service. We do not store your full credit card details on our servers.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you believe you have been charged in error, contact us at support@sweetspotcrm.com within 30 days.

4.5 Price Changes

We reserve the right to modify our pricing. Any price changes will be communicated at least 30 days in advance via email and will take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit malware, viruses, or any destructive code
  • Attempt to gain unauthorized access to the Service or its systems
  • Use automated scripts to access the Service without our prior written consent
  • Store or transmit content that is unlawful, defamatory, or harmful
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Misrepresent your identity or affiliation with any person or entity

6. Data Ownership and Licensing

6.1 Your Data

You retain full ownership of all data, content, and materials you upload, input, or generate through the Service ("Your Data"). We do not claim ownership of Your Data.

6.2 License to Us

You grant us a limited, non-exclusive, worldwide license to use, store, process, and display Your Data solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete Your Data or close your account.

6.3 AI-Generated Content

Content generated by our AI assistant AleX (including proposals, summaries, and suggestions) is provided as-is. You are responsible for reviewing and verifying all AI-generated content before using it in a business context. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

7. Intellectual Property

The Service, including all software, designs, trademarks, logos, and documentation, is owned by SweetSpotCRM Ltd. and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described therein.

9. Third-Party Integrations

The Service may integrate with third-party services (e.g., email providers, calendar systems, cloud storage). We are not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party integrations is subject to those services' respective terms and privacy policies.

10. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable for any modifications, suspensions, or discontinuations of the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SweetSpotCRM Ltd., its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

13. Indemnification

You agree to indemnify, defend, and hold harmless SweetSpotCRM Ltd. and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SweetSpotCRM Ltd. is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice within the Service at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
